General Terms, COnditions

These General Terms and Conditions (T&C’s) of MRKC Morkoc Aras (hereinafter referred to as MRKC) in their current version are directed at consumers and apply to all use of this website (www.mrkc.at), particularly for any order placed through the online shop. In the event of changes to these General Terms and Conditions, the version published on the internet at the time of the order shall apply.

All obligations under this contract will be performed at the registered office of MRKC Morkoc Aras, Floridsdorfer Hauptstrasse 29, 1210 Vienna.

Returns

Returns are only permitted if they have been registered with MRKC in writing (by post, fax, or email) beforehand or if the customer has properly exercised their right of withdrawal within the designated time and format. Returns must only be made following explicit instructions from MRKC. Unauthorized returns, made without prior instruction from MRKC, will not be eligible for a refund or reshipment of goods. The cost of returning the items is borne by the buyer.

Liability Disclaimer

Claims for damages against MRKC related to the use of this website and in connection with legal transactions with MRKC are excluded, except in cases of personal injury or if MRKC or a person for whom MRKC is responsible has caused the damage intentionally or through gross negligence; such cases must be proven. Consumer transactions are exempt from this provision. Any further liability is excluded, except for claims under the Product Liability Act. In particular, compensation for (defect-related) consequential damages, as well as other material damages, financial losses, and third-party damages against the customer, is excluded unless it involves a consumer transaction.

All information has been carefully researched, but errors or typographical mistakes cannot be completely excluded.

Shipping and delivery

To place an order in the online shop, the following information is required from customers: full name, address, any alternative delivery address, and a valid email address.
After completing the order, the customer will receive a confirmation email, which must be thoroughly checked for accuracy and can be saved by the customer.
Placing an order in the online shop does not yet constitute a contract between MRKC and the customer.
Prices are quoted in euros (€) and are exclusive of VAT (in accordance with § 6 Abs. 1 No. 27 of the Austrian VAT Act (UStG).

Shipping of goods by MRKC is free for orders over €1,000 and will be delivered to the specified shipping address.

The delivery time provided by MRKC serves as a guideline and is non-binding. Delays due to unforeseen events, force majeure, or similar circumstances are excluded and will extend the delivery time by the duration of the event.

Once the goods leave MRKC’s warehouse, the customer will receive a confirmation email.

Payment Terms and Transfer of Ownership

Payment in the online shop is possible by credit card, instant bank transfer, or via PayPal (account required).

The contract with MRKC is concluded when the goods are handed over to the buyer or to an authorized person. However, the goods remain the property of MRKC until full payment (including all incidental costs) has been made.

The following credit cards are accepted: Visa, Mastercard, debit cards. The processing/data transmission is carried out via encrypted paths with the highest security standards through our partner wooPayments, which debits the amount from your credit card upon successful payment. However, the goods remain the property of MRKC until full payment has been received in our account.

A shipping confirmation will be sent to the customer upon dispatch of the goods. Invoices can be requested at office@mrkc.at.

Delivery

Delivery is carried out by Austrian Post/DHL. Deliveries in areas with restricted delivery times can only be made during those times and may delay the delivery. Additionally, deliveries can only be made on paved, accessible roads.

The average delivery time is 3-14 working days within EU and 7-30 working days outside EU, but this may vary depending on the season, conditions, and potential overload of the shipping service provider. The delivery period starts one working day after the handmade manufacturing of your garment is finished and handed over to the carrier.

Personalized orders may take significantly longer.

Right of Withdrawal/Right of Rescission

You have the right to withdraw from this contract within fourteen days without providing any reason. The withdrawal period is fourteen days from the day on which you or a third party appointed by you, who is not the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must inform us, MRKC, of your decision to withdraw from this contract by a clear statement (e.g., a letter sent by post, fax, or email).

To meet the withdrawal deadline, it is sufficient to send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without delay, and no later than fourteen days from the day on which we received your notification of withdrawal from this contract. We will use the same means of payment as you used for the original transaction, unless a different arrangement has been expressly agreed upon. You will not incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us without delay and no later than fourteen days from the day you notified us of the withdrawal from this contract. The deadline is met if you dispatch the goods before the fourteen-day period has expired.
You will bear the direct costs of returning the goods.
You are only responsible for any diminished value of the goods if the loss in value is due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to the following contracts:

1. Contracts for the delivery of goods that are not pre-made and for which the production is based on an individual selection or specification by the consumer, or which are clearly tailored to the consumer’s personal needs, such as personalized orders.
2. Contracts for the delivery of goods that are not suitable for return due to health protection or hygiene reasons if they have been opened or used after delivery.

Please return the item to us, if possible, in its original packaging and as complete as possible.
